1. Introduction

The Committee to Elect Dyana Forester, operating as Dyana for DC (hereinafter "the Campaign"), is committed to protecting the privacy and personal information of our supporters, volunteers, donors, and all individuals who engage with our campaign. This Privacy Policy and Information Usage Policy describes how we collect, use, and protect your personal information, and outlines our compliance with applicable federal and District of Columbia laws governing political communications, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and DC Board of Elections regulations.

By providing your contact information to the Campaign, whether through our website, at an event, via text opt-in, or otherwise, you agree to the terms of this Policy.

 

2. Information We Collect

The Campaign may collect the following types of personal information:

  • Full name

  • Home and/or mailing address

  • Email address

  • Mobile and/or home phone number

  • Employer and occupation (required for contributions over $50 under DC law)

  • Contribution amount and payment method details (processed through secure third-party processors)

  • Volunteer availability and skills

  • Any other information you voluntarily provide

 

3. How We Use Your Information

Personal information collected by the Campaign will be used solely for campaign-related purposes, including:

  • Communicating campaign updates, events, and volunteer opportunities

  • Processing donations and issuing required disclosures

  • Sending text messages and emails for campaign outreach (with your prior express written consent where required)

  • Complying with DC and federal campaign finance reporting requirements

  • Coordinating volunteer activities

We will not use your information for any commercial purpose unrelated to this political campaign.

 

4. No Sale or Sharing of Personal Information

The Campaign will NEVER sell, rent, trade, or otherwise share your personal information with:

  • Third-party vendors for commercial marketing or advertising purposes

  • Other political campaigns, PACs, or political committees

  • Corporations, businesses, or non-campaign organizations

  • Any individual or entity for compensation or non-campaign use

Information may only be disclosed in the following limited circumstances:

  • As required by law, including DC Board of Elections campaign finance disclosure filings

  • To service providers who assist in operating the Campaign (e.g., email and SMS platforms, donation processors), who are contractually prohibited from using your data for any other purpose

  • In response to a lawful subpoena, court order, or legal process

 

5. Text Message (SMS) Communications — TCPA Compliance

 

5.1 Express Written Consent

The Campaign sends text messages only to individuals who have provided prior express written consent as required by the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227. Consent may be obtained through:

  • Completing an opt-in form on our website

  • Texting a designated keyword to our campaign short code or long code

  • Signing a physical opt-in form at a campaign event

Providing your phone number alone does not constitute consent to receive automated text messages.

 

5.2 Opt-Out / Unsubscribe

You may opt out of campaign text messages at any time by replying STOP to any message. You may also text HELP for assistance. After opting out, you will receive one final confirmation message and no further texts will be sent to that number, except as required by law.

 

5.3 Message Frequency & Rates

Message frequency varies based on campaign activity. Standard message and data rates from your mobile carrier may apply. The Campaign is not responsible for charges incurred by your wireless provider.

 

5.4 Prohibited Conduct

The Campaign does not engage in the following prohibited practices:

 

  • Continuing to text individuals who have submitted a valid STOP request

  • Sending messages at hours prohibited under applicable law

 

6. Email Communications — CAN-SPAM Compliance

All campaign emails comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.). Each email we send will:

  • Clearly identify Dyana For DC as the sender

  • Include a valid physical mailing address for the Campaign

  • Contain a clear and conspicuous mechanism to unsubscribe from future emails

  • Honor unsubscribe requests within ten (10) business days

  • Not use deceptive subject lines or header information

To unsubscribe from campaign emails, click the "Unsubscribe" link at the bottom of any campaign email or contact us directly at the information provided in Section 10 below.

 

7. Data Security

The Campaign takes reasonable administrative, technical, and physical measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include:

  • Secure, password-protected access to campaign databases

  • Use of reputable and TCPA/CAN-SPAM compliant third-party platforms for email and SMS communications

  • Limiting access to personal information to authorized campaign staff and volunteers with a legitimate need

While we strive to protect your data, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.

 

8. Data Retention

The Campaign retains personal information for as long as necessary to fulfill campaign purposes and comply with legal obligations, including DC Board of Elections record retention requirements. Contribution records are retained for a minimum period as required by law. Upon conclusion of the campaign, personal data not required for legal retention will be securely deleted or destroyed.

 

9. Your Rights

You have the right to:

  • Request access to the personal information we hold about you

  • Request correction of inaccurate information

  • Opt out of text message and/or email communications at any time

  • Request deletion of your information, subject to our legal retention obligations

The Campaign reserves the right to update this Privacy Policy at any time. Any material changes will be posted on our website with an updated effective date. Continued engagement with the Campaign following notice of changes constitutes acceptance of the revised Policy.
